You agree to indemnify and hold LEVC and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against LEVC arising out of any breach by you of these terms and conditions or other liabilities arising out of your use of this website.

Severance
If any of these terms and conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such term or condition shall be severed and the remaining terms and conditions shall survive and remain in full force and effect and continue to be binding and enforceable.

Governing law
These terms and conditions shall be governed by and construed in accordance with the law of England and you hereby submit to the exclusive jurisdiction of the English courts.

 

TX Test Drive Terms and Conditions

Participants must hold a valid full UK driving license which must be presented on the day of the test drive.

Participants must print and bring along their DVLA License summary upon arrival in order to take part in any driving activity. You can download your license summary at: www.gov.uk/view-driving-licence . To do this you will need: your driving license number and national insurance number.

TX test drive sessions are allocated exclusively by invitation only and may not be transferred to third parties.

Participation is permitted for one person only (the intended recipient).

Test drive participants are required to arrive 10 minutes before their allocated session time to complete paperwork before their test drive. Late arrivals will be requested to rebook via www.theelectrictaxi.co.uk/test-drive.

 

TX Accompanied Test Drives

The Participant:

1. Is in possession of a current full UK driving licence and is not banned or disqualified from driving.

2. Agrees that in taking part in this activity, he/she Is driving at their own risk and the choice is theirs to participate.

3. Acknowledges that neither LEVC Ltd nor any of its employees or agents shall be liable in respect of any action, costs, claims, damages or expenses (whether direct, indirect or consequential) whatsoever which arise out of or in connection with this driving activity.

a. LEVC does not limit its liability (if any) for death or personal injury caused by its negligence (or that of its employees or agents) or for any matter which it would not be lawful to exclude such liability.

4. Agrees that LEVC’s motor insurance policy is subject to £1,000 accidental damage, fire, theft and windscreen excess.

a. The Participant will be responsible for reimbursement of any loss or damage falling within this excess. In the event of a non-fault claim to a third party, LEVC will assist in reclaiming the uninsured loss.

5. Agrees that the vehicle he/she is operating for this activity will not be used for hire and reward.

6. Will wear a seatbelt at all times and drive with due courtesy to other road users.

7. To the best of his/her knowledge does not suffer from any physical or mental illness or disability, permanent or temporary, which may make it unsafe for them to drive.

8. Confirms that his/her eyesight meets the standard required for the driving test.

9. Confirms that he/she will not operate this vehicle under the influence of alcohol or any other substances that may affect their ability to drive.

10. Accepts that at any time LEVC, its employees or agents, reserve the right to cease their participation in driving the vehicle in the interests of safety and/or the needs of the business.

11. Accepts full liability for any road traffic management infringements caused whilst he/she is in charge of the vehicle.

12. Holds a valid hackney carriage licence.

13. Agrees for LEVC to contact the DVLA to undertake a driving licence summary check where required.

48 Hour Vehicle Loan

The Loanee:

1. Is aged between 25 and 70 years of age.

2. Holds a valid full UK/EU licence which is appropriate for the use of the vehicle for a minimum of 2 years and is not banned or disqualified from driving.

a. A Loanee who does not comply with terms 1. and 2. above OR falls within points (a) to (f) below are NOT covered to drive under the policy without the express prior permission of the Insurer:

The Loanee:

(a) has been refused motor vehicle insurance or continuance thereof, or
(b) has been either convicted of or charged with (but not tried) of any non motoring offence, or
(c) has not been continuously resident in the United Kingdom for a minimum period of 3 years, or
(d) has suffered from any disability or medical condition which has not been notified to the DVLA or which has been notified but resulted in the refusal of a driving licence for the class of vehicle to be driven
(e) has during the last 5 years been convicted of or has a pending prosecution for any of the following motoring offences:

(i) manslaughter
(ii) causing death by dangerous driving (Conviction code CD40,
CD50, CD60, CD70, CD80, CD90)
(iii) dangerous driving (All ‘DD’ prefixed conviction codes)
(iv) driving under the influence of drink/drugs (All ‘DR’ prefixed conviction codes)
(v) failing to stop after an accident (All ‘AC’ prefixed conviction codes)
(vi) theft or unauthorised taking of a motor vehicle (All ‘UT’ prefixed conviction codes)
(vii) miscellaneous offences (Conviction code MS40, MS50, MS60, MS70, MS80)
(f) has during the last 3 years been convicted of or has a pending prosecution for any offence or combination of offences:
(i) Which result or may result in more than 9 penalty points being endorsed on his/her driving licence.
(ii) Which result or may result in a loss of licence or suspension/ban from driving.

3. Holds a valid hackney carriage licence.

4. Is NOT permitted to sub-loan the vehicle to any other driver or allow another driver to operate this vehicle whilst in their care and/or during the period of the loan agreement.

5. To the best of their knowledge, does not suffer from any physical or mental illness or disability, permanent or temporary, which may make it unsafe for him/her to drive.

6. Confirms that his/her eyesight meets the standard required for the driving test.

7. Confirms that he/she will not operate this vehicle under the influence of alcohol or any other substances that may affect his/her ability to drive.

8. Is responsible for delivering the vehicle back to LEVC’s agreed premises upon the completion of the loan period.

9. Is responsible for ensuring the vehicle is returned to LEVC within the agreed 48hr loan period or a time agreed with LEVC.

10. Agrees to contact LEVC immediately, should any mechanical or cosmetic defect be discovered whilst in their care.

a. agrees to a possible early termination of the vehicle loan, should LEVC deem any reported defect a risk to safety of the Loanee, their passengers or anyone whosoever could be affected by a potential incident.

11. Agrees to keep the vehicle in good, clean, working order whilst in his/her care.

a. accepts full responsibility for the vehicle and all equipment & accessories supplied with/ fitted to the vehicle.
b. agrees to be held liable for the full replacement cost of any such items found missing or damaged beyond normal wear and tear.
c. no depreciation charge will be made for the vehicle when it is returned after the loan period has completed.

12. Accepts full liability for parking penalties, road traffic management infringements and/or any other road traffic offences incurred relevant to the vehicle whilst the vehicle is in his/her possession.

a. In the event of any such penalty, a copy of the loan agreement will be passed to the relevant authority by the Loanee in order that the charge can be transferred to the Loanee.
b. The Loanee agrees to ensure payment is made without delay for any financial penalty imposed due to an offence that is relevant to the vehicle whilst the vehicle is in his/her possession.

13. In the event of any road traffic accident involving the vehicle, the Loanee will ensure that all relevant details will be recorded at the scene and will be reported to the Owner (LEVC).

14. Acknowledges that neither LEVC Ltd nor any of its employees or agents shall be liable in respect of any action, costs, claims, damages or expenses (whether direct, indirect or consequential) whatsoever which arise out of or in connection with this vehicle loan.

a. LEVC does not limit its liability (if any) for death or personal injury caused by its negligence (or that of its employees or agents) or for any matter which it would not be lawful to exclude such liability.

15. Is liable for an excess fee of up to £1,000 accidental damage, fire, theft and windscreen excess under LEVC’s motor insurance policy covered by this vehicle loan.

a. The Loanee is responsible for reimbursement of any loss or damage falling within this excess.
b. In the event of a non-fault claim to a third party, LEVC will assist in reclaiming the uninsured loss.

16. Agrees to wear a seatbelt at all times and drive with due courtesy to other road users.

17. Accepts that at any time LEVC, its employees or agents, reserve the right to cease the vehicle loan if in the interests of the business.
